Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and AptiEdge ("Company", "we", "us", "our") governing your access to and use of the AptiEdge website, mobile application, and all related services (collectively, the "Platform").

By accessing or using the Platform, creating an account, or clicking "I agree to the Terms & Conditions" during registration, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

These Terms are published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 and the Information Technology Act, 2000 ("IT Act"), and are governed by the laws of the Republic of India.

Eligibility

To use the Platform, you must:

• Be at least 13 years of age. Users under 18 must have parental or guardian consent.
• Be a natural person, not a corporation, entity, or automated system.
• Have the legal capacity to enter into a binding contract under applicable Indian law, including the Indian Contract Act, 1872.
• Not be prohibited from receiving services under applicable law, including persons on any government watchlist or denial-of-service list.

By using the Platform, you represent and warrant that you meet all the above eligibility requirements.

Account Registration

To access certain features of the Platform, you must create an account by providing accurate, complete, and current information including your full name, email address, phone number, and password. You agree to:

• Provide truthful, accurate, and complete registration information.
• Maintain and promptly update your account information to keep it accurate.
• Maintain the confidentiality of your password and restrict access to your account. You are responsible for all activities that occur under your account.
• Notify us immediately at aptiedgeorg@gmail.com upon becoming aware of any unauthorised access to or use of your account.
• Not share your account credentials with any third party or allow any other person to use your account.
• Not create more than one account per individual. Duplicate accounts may be suspended without notice.

Services & Subscriptions

AptiEdge provides an online exam preparation platform offering daily practice targets, sectional tests, mock tests, courses, leaderboards, and related educational content. Access to specific features may require a paid subscription plan.

Free Plan: Limited access to daily targets and basic features at no charge.

Paid Plans: Subscription-based access to full feature sets as described on our Pricing page. All subscription fees are listed in Indian Rupees (INR) and are inclusive of applicable taxes.

• Subscriptions are billed in advance on a monthly or annual basis, as chosen at the time of purchase.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; no partial refunds are provided unless required by the Consumer Protection Act, 2019.
• We reserve the right to modify pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
• We reserve the right to modify, suspend, or discontinue any part of the Platform with reasonable notice, and will not be liable for such modifications.

Intellectual Property Rights

All content on the Platform — including but not limited to text, questions, explanations, images, graphics, logos, audio, video, software, and course material — is the exclusive property of AptiEdge or its licensors and is protected by applicable intellectual property laws, including the Copyright Act, 1957, the Trade Marks Act, 1999, and international treaties.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal, non-commercial educational purposes. This licence does not permit you to:

• Copy, reproduce, distribute, publicly display, or create derivative works of any Platform content.
• Scrape, crawl, data-mine, or use automated tools to extract content from the Platform.
• Sell, sublicense, or commercially exploit any content from the Platform.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
• Use any content for commercial coaching, tutoring, or resale without prior written consent.

Any unauthorised use of Platform content constitutes an infringement of our intellectual property rights and may result in civil and criminal liability under applicable Indian law.

User Obligations & Prohibited Conduct

You agree to use the Platform only for lawful purposes and in a manner consistent with applicable law. You must not:

• Use the Platform in violation of any law, including the IT Act, 2000, the DPDP Act, 2023, or any other applicable statute.
• Upload, post, or transmit any content that is defamatory, obscene, sexually explicit, hateful, threatening, or otherwise objectionable.
• Engage in cheating, impersonation, or fraudulent conduct during tests or assessments.
• Attempt to gain unauthorised access to any part of the Platform or other users' accounts.
• Introduce viruses, trojans, worms, or other malicious software to the Platform.
• Perform denial-of-service attacks or otherwise disrupt the Platform's availability.
• Use the Platform to harvest or collect personal data of other users.
• Share, distribute, or publish examination questions, answers, or explanations from the Platform on any third-party platform, social media, or messaging application.
• Circumvent any access control or digital rights management measures on the Platform.

Content & Data

The educational content on the Platform — including questions, answers, explanations, and courses — is prepared by AptiEdge or licenced from trusted partners. While we strive for accuracy, we do not guarantee that any content is free from errors or is current with the latest examination patterns.

Any data generated by your use of the Platform (e.g., test scores, attempt history, performance analytics) is stored by us and used to improve your learning experience and the Platform. For details on how we handle your personal data, please review our Privacy Policy.

Third-Party Links & Services

The Platform may contain links to third-party websites or services (e.g., payment gateways, external resources). These links are provided for convenience only. AptiEdge:

• Does not endorse, control, or take responsibility for third-party content, policies, or practices.
• Is not liable for any damages or losses arising from your use of third-party services.
• Recommends that you review the privacy policies and terms of any third-party services you access through the Platform.

Payment processing is handled by authorised payment aggregators compliant with the Payment and Settlement Systems Act, 2007 and Reserve Bank of India guidelines.

Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AptiEdge does not warrant that:

• The Platform will be uninterrupted, error-free, or secure at all times.
• Examination content reflects the current syllabus or pattern of any specific examination body.
• Use of the Platform guarantees success in any examination.
• Defects in the Platform will be corrected on any specific timeline.

Content on the Platform is for general educational purposes only and does not constitute professional advice of any kind.

Limitation of Liability

To the maximum extent permitted by applicable law, AptiEdge and its officers, directors, employees, agents, and licensors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of data, profits, revenue, or business opportunity arising from your use or inability to use the Platform.
• Errors, mistakes, or inaccuracies in content on the Platform.
• Unauthorised access to or use of our servers or any personal data stored therein.

In no event shall our aggregate liability to you for any claims arising out of or relating to these Terms exceed the amounts you have actually paid to us in the 12 months preceding the claim, or ₹500, whichever is greater.

Some jurisdictions do not allow certain limitations of liability. In such cases, liability is limited to the fullest extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless AptiEdge and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or related to:

• Your violation of these Terms.
• Your use or misuse of the Platform.
• Your violation of any third-party right, including any intellectual property or privacy right.
• Your violation of any applicable law or regulation.

Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and share your personal data in accordance with:

• The Digital Personal Data Protection Act, 2023 (DPDP Act)
• The Information Technology Act, 2000 and IT Rules, 2011
• The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011

By using the Platform, you consent to the collection and processing of your data as described in the Privacy Policy.

Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page.
• Notify registered users via email or a prominent notice on the Platform.
• Where required by law, seek renewed consent before the modified Terms take effect.

Continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Platform and may request account deletion at aptiedgeorg@gmail.com.

Termination

We may suspend or terminate your account and access to the Platform at our sole discretion, without prior notice or liability, if:

• You breach these Terms or any applicable law.
• Your account is found to be involved in fraudulent, abusive, or illegal activity.
• We are required to do so by a court order or government directive.
• We discontinue the Platform or any part of it.

Upon termination, your right to use the Platform immediately ceases. You may request a copy of your personal data within 30 days of termination by contacting our Grievance Officer. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 5, 10, 11, 15, and 16.

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

Dispute Resolution: In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof, the parties shall first attempt to resolve the matter amicably through good-faith negotiations within 30 days of the dispute arising.

If the dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the competent courts located in India. You agree to submit to the personal jurisdiction of such courts.

Nothing in this section shall prevent us from seeking interim or injunctive relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

Grievance Officer

In accordance with Rule 3(2) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021 and Section 5 of the DPDP Act, 2023, we have designated a Grievance Officer to address your concerns.
